ICO Requirements for Landlords

Who Needs to Register?

Individual Landlords & Limited Company:

If you collect and process tenant information, next of kin information, guarantors information, tenants references or personal ID you must  register with the ICO. If you are a limited company you must be registered with the ICO if you handle the personal information of your tenants. 

If your rental property has CCTV you must be registered with the ICO for the footage you collect. (Please see our CCTV Packages).

Letting Agents & Property Managers:

Even if you use a letting agent, the responsibility to comply with GDPR may still fall on you as the Data Controller meaning that you would need to be registered. 

HMO Landlords:

If you manage Houses in Multiple Occupation (HMOs), you must register, as handling the personal data of multiple tenants classifies you as a Data Controller. This may be a condition of your HMO licence.
